JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 21-12-2015 Petitioners apprehend their arrest in case under Section 420 and other allied Section of the Indian Penal Code. Petitioner Arvind Kumar Sah is local Mukhiya, and the Chairman of the Selection Committee, whereas petitioner Anjuma, @ Anjuma Khatoon, is a ward member. The allegation is that the appointment committee appointed one Shiv Kumar Mandal, on the strength of a false birth certificate. Petitioners submit that said Shiv Kumar Mandal has already been granted anticipatory bail vide order dated 21.9.2015 passed in CR. Misc. No. 24384 of 2015. Similarly

Patna High Court Cr.Misc. No.50420 of 2015 (2) dt.21-12-2015 2/2 Sonia Devi, a Ward member has also been granted anticipatory bail vide order dated 01.07.2015, passed in CR. Misc. 26008 of 2015.

In the facts of the case, in case of surrender, let both the petitioners, named above, be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Birpur Supaul, in Raghopur Police station Case No. 49/2014.

The petitioner Arvind Kumar Sah, would not physically absent for two consecutive dates at a stretch, till one witness is examined in the trial, failing which bail bond would be cancelled.
