2. The petitioner apprehends his arrest in the present case registered for offences under Sections 302,34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the allegation against the petitioner is that he along with co-accused persons surrounded the informant's father and co-accused Chandan Kumar fired bullet upon the father of the informant.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. During investigation, it has come that only one person like Chandan Kumar was seen running away. The entire prosecution story has been falsified during investigation. The learned

Patna High Court CR. MISC. No.65877 of 2024(3) dt.20-01-2025 2/2 counsel for the petitioner has also submitted that the co-accused Chandan Kumar Rai @ Chandan Kumar has been granted regular bail by this Court vide order dated 04.08.2023 passed in Cr. Misc. No. 45789 of 2023.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/concerned court below in connection with Katra P.S. Case No. 403 of 2022 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
