For the Petitioner/s : Mr. Pankaj Kr. Sinha, Advocate Mr. Kamal Kishore Jha, Advocate For the Opposite Party/s : Mr. C. Jawahar, APP =========================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 11-02-2016 The Petitioner seeks quashing of the order dated 23.9.2010, by which the Judicial Magistrate, 1st class, Munger in Complaint case No.304C of 2005 rejected an application of the Petitioner when it was remanded to him by the Revisional Court. I find that charge in the present case has been pending since the year 2006 and evidently this case has been filed only so as to delay the trial.
On perusal of the records, I find no merit in the application and hence the same is dismissed.
The Trial Court is directed to conclude the trial positively within a period of six months from the date of receipt of
Patna High Court Cr.Misc. No.47586 of 2014 dt.11-02-2016 2/2 this order without granting unnecessary adjournments to any party. The Revisional Court's order dated 2.9.2014 passed in Criminal Revision No.290 of 2010 is hereby set aside. (Anjana Prakash, J) Narendra/- U T
