JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Baisi P.S. Case No. 184 of 2017 (S.T. No. 34 of 2018) for the offence under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the present case is counter blast of the case earlier lodged by the petitioner's side, as would be evident from Annexure-2. He submits that the petitioner has got clean antecedent. The petitioner is languishing in jail since 23.09.2017. He submits that from perusal of the Fardbeyan, it would be evident that there was omnibus allegation and there is no specific allegation that this petitioner has given specific blow, leading to the death of the deceased.

No. 34 of 2018, arising out of Baisi P.S. case no. 184 of 2017.
