ANSHUMAN ORAL ORDER 24-02-2023 Counsel for petitioner submits that due to inadvertence, he could not mention the point of custody in the petition. He seeks permission to include the point of custody. Permission granted to remove the defects in course of the day.

Let the defect(s), if any, be removed within two weeks from today.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Paliganj P.S. Case No. 51 of 2022 lodged under Sections 366(a) of the I.P.C.

As per the prosecution case, allegation of kidnapping with a view to marry, is there in the F.I.R. against 6 accused

Patna High Court CR. MISC. No.56631 of 2022(2) dt.24-02-2023 2/2 persons, including the present petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 05.05.2022 having clean antecedent. Counsel submits that the statement of the alleged victim took place under Section 164 of Cr.P.C., in which she has completely denied the prosecution story, which is Annexure-2.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur in connection with Paliganj P.S. Case No. 51 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
