N o n e ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-11-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

2. Despite filing Vakalatnama, no one appears on behalf of the informant/Opposite Party No. 2.

3. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 329(3), 126(2), 115(2), 76, 303(2), 351(2), 352 and 3(5) of the B.N.S..

4. As per prosecution case, on 26.04.2025 at about 7 AM, this petitioner tried to outrage the modesty of daughter of informant by pulling her hand and when informant and others came to save, they were brutally assaulted.

5. It is submitted by learned counsel appearing on

Patna High Court CR. MISC. No.57483 of 2025(3) dt.25-11-2025 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, she goat of informant strayed in the house of this petitioner which led to a quarrel. The present case is counter-blast of Ramnagar P.S. Case No. 255 of 2025 which was lodged, earlier in point of time, by this petitioner against informant and others and in retaliation, this false and concocted case has been lodged. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. Petitioner claims clean antecedents.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

7. Considering the facts and circumstances of the case, general and omnibus nature of accusation, case and counter-case between the parties and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

8. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
