Petitioner seeks bail in connection with POCSO Reg. No. 43 of 2017 arising out of Bhabhua P.S. Case No. 681 of 2017 for offences punishable under Sections 354 (c)/506 of the Indian Penal Code, Section 12 of POCSO Act and Section 66 (e) (a) (d) of Information and Technology Act.

The prosecution case, as lodged by the informant, is that she is a class IX student and the petitioner has been following her and also made vulgar video as they are both neighbors. It has been submitted by the learned counsel for the petitioner that he is innocent, the petitioner is also an young boy

Patna High Court Cr.Misc. No.1107 of 2018 (3) dt.13-02-2018 2/2 and both were having love affair but later on was objected by the family members. He submits that no vulgar video of the victim girl has been taken and the allegations are false and baseless. He submits that informant has also lodged another case against the petitioner and the family members for the same allegations and that petitioner is in judicial custody since 02.11.2017. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st-cum-Special Judge, Kaimur at Bhabua in connection with POCSO Reg. No. 43 of 2017 arising out of Bhabhua P.S. Case No. 681 of 2017.
