Petitioner seeks regular bail in connection with Nauhatta P.S. Case No.52 of 2022 registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

As per the prosecution, the informant's minor daughter aged about 16 years was kidnapped by this petitioner with the help of other accused persons.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner has fair and clean antecedent and in present the so-called victim has been recovered and she has recorded her statement before the Judicial Magistrate in which she denied the allegations of the FIR.

Learned APP appearing for the State has opposed the bail prayer.

In view of the facts, as stated above, and mainly considering the petitioner's young age, his clean antecedent and his academic career as well as his custody period and also the victim's statement recorded by her before the Judicial Magistrate which goes against the allegations of the FIR, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Nauhatta P.S. Case No.52 of 2022.
