ANJANA MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 239 of 2015 for the offences registered under Sections 366(A) of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is the elder brother of one Arvind Kumar Thakur, who is said to have kidnapped the sister of the informant and he is living separately. It is further submitted that the said Arvind Kumar Thakur eloped with the sister of the informant and they had got married at a temple. Now the girl is expected to deliver a child in June, 2016 and soon after the delivery of the child he shall produce the girl for proper adjudication of the matter.

No.11038 of 2016 (3) dt.20-05-2016 Considering the fact that the petitioner has virtually no role to play and has undertaken to produce the girl in the court below after the deliver of the child, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 239 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
