Petitioner, already in custody, seeks bail in connection with Kotwali (Purabsarai) P.S. Case No.234 of 2017, registered under Sections 341 and 307/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that suspicion is raised that the petitioner and two other named accused persons have shot at the son of the informant.
Learned counsel for the petitioner contends that there is general and omnibus allegation against all the accused persons, informant is not the eye witness and only one lacerated wound over the neck of the son of the informant was found, there was no exit wound and there is no opinion that it is a fire arm injury,
Patna High Court Cr.Misc. No.57198 of 2017(6) dt.26-03-2018 2/2 besides this the injured was referred to PMCH but he has not come to PMCH for treatment, the petitioner has no criminal antecedent and he is in custody since 06.07.2017. Having considered the aforesaid facts and circumstances, petitioner Shahnawaz Hoda @ Sahwaz is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Kotwali (Purabsarai) P.S. Case No.234 of 2017.
