The only ground raised by the petitioner in the petitioner is that is the instead of 495 quintals of food grains, he has mis-appropriated only 245 quintals of food grains and therefore F.I.R. may be quashed.

Even if the petitioner has mis-appropriated one quintal, the F.I.R. cannot be quashed.
