Heard the learned counsel for the petitioner and learned APP.

The petitioner apprehends his arrest for the offences alleged under Sections 411, 414, 323, 504, 353, 332, 333 and 34 of the Indian Penal Code, registered in connection with Kateya P.S.Case No. 308 of 2021.

As per the allegation, when the checking of vehicles was going on, two persons rided on motorcycles were apprehended by the informant who is an ASI. The apprehended persons disclosed their names as Guddu Chauhan and Sunil Rai. They failed to produce papers in respect of that motorcycle. They disclosed that they were

Patna High Court CR. MISC. No.68053 of 2021(3) dt.22-09-2022 2/2 working for Namuna Khatik and after stealing the motorcycle they handed it over to Rakesh Gupta and his brother, the present petitioner.

Learned counsel for the petitioner has submitted that petitioner has not been arrested at the spot. Nothing was recovered from his possession. His name has figured only in confessional statement of co-accused and he is a person of clean antecedent. Considering the above facts and circumstances, especially the clean antecedent of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Gopalganj in connection with Kateya P.S.Case No. 308 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
