JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 17.12.2015 in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code which was lodged against the petitioner and two others on 16.12.2015 with accusation that petitioner and other F.I.R. named accused kidnapped the informant's minor daughter for the purpose of marriage. Admittedly, petitioner was caught by the police just one day after the alleged occurrence and victim was not recovered from his conscious possession.

Contention on behalf of the petitioner is that the victim was in love with co-accused, Kundan Raj, who happens to

Patna High Court Cr.Misc. No.12145 of 2016 (2) dt.29-03-2016 2/2 be full brother of the petitioner and as a matter of fact, the victim eloped with the aforesaid co-accused, Kundan Raj and the informant got arrested the petitioner taking the local police in his collusion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 1030 of 2015.
