ANJANA MISHRA ORAL ORDER 26-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is the PACS Manager and has been in custody since 21.12.2017 in connection G.R. Case No. 1447/2017 arising out of Rauta P.S. Case No. 31 of 2017 registered for the offences punishable under Sections 420/406/409 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is the PACS Manager of Shishabari PACS is alleged to has withdrawn a total amount of Rs. 6,37,809/- in two transactions for construction of the PACS godown of the capacity of 200 MT. It is alleged that the said godown is not constructed as per the standard work order. Learned counsel for the petitioner has, however, submitted that allegations are false and baseless and the entire amounts which have been released in construction of the godown was not made. It is only the bills which indicate construction work that have been released by the
Patna High Court Cr.Misc. No.18846 of 2018 (3) dt.26-04-2018 2/2 petitioner. He further submits that similarly situated co-accused have since been extended the privilege of bail in Cr. Misc. No. 17280/2018 vide order passed today itself.
In view of the aforementioned facts and circumstances and the nature of allegations, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.,-II, Purnea in connection with G.R. Case No. 1447/2017 arising out of Rauta P.S. Case No. 31 of 2017.
