The petitioners are apprehending their arrest in connection with Rudrapur P.S. Case No. 42 of 2015, G.R. No. 682/2015 for the offences instituted under Sections 341, 323, 307, 379 and 504/34 of the IPC.
The prosecution story, in brief, is that Rahul Kumar Jha had hit with iron-rod on the informant's head and Parma Nand Jha had hit Durganand Jha.
It has been submitted on behalf of the petitioners that it is a case and counter-case between the parties. Both the petitioners and the informant are close agnates and reside in a same
Patna High Court Cr.Misc. No.48285 of 2015 (2) dt.01-02-2016 2/2 courtyard. From perusal of the injury report Annexures- 2 and 3, it would appear that the nature of injuries are said to be simple in nature. Hence, no offence under Section 307 IPC is attracted in the present case.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Rudrapur P.S. Case No. 42/2015, G.R. No. 682/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Jhanjharpur, Madhubani, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
