Petitioner seeks bail in a case registered under Sections 341 and 307/34 of the Indian Penal Code and section 27 of the Arms Act and section 17 of the Criminal Law Amendment Act. It is submitted that initially the case was registered under sections 341 and 307/34 of the Indian Penal Code and section 27 of the Arms Act and section 17 of the Criminal Law Amendment Act but later on section 302 of the Indian Penal Code was added as the victim had died. It does not stand stated in the First Information Report as to who had actually fired at the victim Feku Rai. It is contended that the petitioner does not have any criminal antecedent and one of the co-accused, namely, Anwar, has already been granted bail by a Coordinate Bench of this Court

Patna High Court Cr.Misc. No.48621 of 2014 (2) dt.03-03-2015 vide order dated 12.09.2014 passed in Criminal Miscellaneous No. 27074 of 2014 contained in Annexure 4.

Having regard to the facts and the circumstances of the case, the petitioner, Dinesh Mandal, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in Runnisaidpur Police Station Case No. 396 of 2013.
