JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Alouli P.S. Case No. 41 of 2018 for the offence under Section 414 of the Indian Penal Code.
Learned counsel further submits that in the instant case the allegation leveled under Section 414 of the Indian Penal Code is not maintainable for the reason that no case was registered for the offence of theft of motorcycle. He further submits that the name of the petitioner is languishing in jail since 08.02.2018. Considering the fact that there is no of theft of motorcycle and the co-accused has been granted bail by the court below itself, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.27952 of 2018 (3) dt.04-07-2018 2/2 satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alouli P.S. Case No. 41 of 2018.
