JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioners are apprehending their arrest in connection with Complaint Case No. 868 C of 2013 instituted under Sections 323, 379, 504 and 427/34 of the Indian Penal Code.

Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that on 3.7.2013 the complainant went to take new electric connection for one Md. Iliyas Khan where a sum of Rs. 2000/- was demanded by the staff of electricity department and on refusal, they threw the application and pushed him out of the office and when protest was made, accused persons assaulted him by means of fist due to

No.49921 of 2014 (2) dt.08-05-2015 2/3 which blood started oozing from his nose and the petitionerRanjit Kumar took away Rs. 3000/- which had fallen from his pocket and Sub-divisional Electrical Engineer caught the Collar of the complainant and snatched away a golden chain worth Rs. 25,000/- and also broken his optical.

It has been submitted on behalf of the petitioners that the occurrence is said to have taken place in the office of Electricity Board while the petitioners discharging their official duties. It has further been submitted that both the petitioners are Engineers in Electricity Board Department. It has further been submitted that there is a counter case also, which was instituted by the office of the petitioners, which is Annexure 2 to the present case.

On behalf of the State it has been submitted that the petitioners are named in the complaint petition and specific allegation has been against the petitioners.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Complaint Case
