JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with S. Tr. No. 424 of 2017 arising out of Laukariya P.S. Case No. 72 of 2016, a case under Sections 323, 324, 427 and 302 of the Indian Penal Code.

The petitioner is alleged to have committed murder of Gita Kumari, the daughter of the informant. The petitioner is in custody since 18.10.2016.

Earlier prayer was refused on 03.07.2017 in Criminal Miscellaneous No. 24132 of 2017. The report of learned trial judge reveals that the charges have already been framed in the

Patna High Court Cr.Misc. No.794 of 2018 (3) dt.21-02-2018 case.

Submission is that the petitioner is ready to co-operate with the trial.

Learned counsel for the informant opposed the prayer of bail.

Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Laukariya Police Station Case No. 72 of 2016 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
