JUSTICE RAJESH KUMAR VERMA ORAL ORDER 15-12-2022 The present application has been filed for modification of the order dated 03.03.2020 passed in Cr. Misc. No. 9963 of 2020, to extend the time of surrender and furnishing of bail bond.

Learned counsel for the petitioner has submitted that by the aforesaid order the petitioner was extended privilege of anticipatory bail, provided, he shall surrender and furnish bail bond within six weeks but at the relevant point of time, the petitioner was residing in Surat and was working in a private factory to earn his livelihood and could not return back due to lockdown restrictions in view of COVID-19 pandemic. He also submits that due to communication gap he could not surrender within the stipulated time.

No.58201 of 2022(2) dt.15-12-2022 2/2 Be that as it may, the Court is of the view that since the order which is to be modified was passed long back in the year 2020, after a lapse of more than 2 1⁄2 year, at this juncture, the modification petition may not be allowed. Accordingly, the same is rejected.
