The petitioner has been in custody since 17.01.2018 in connection with Sirdala P.S. Case No. 19/2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against this petitioner is that the deceased was called by Arun Bhuiyan and thereafter, one Bablu Bhuiyan has inflicted a lathi blow which led to the death of the husband of the informant. Learned counsel for the petitioner has, however, submitted that there is no eye-witness to the occurrence and it is purely based on speculation and suspicion on account of which the petitioner is

Learned counsel appearing on behalf of the informant, however, submits that there is a clear indication that there was some dispute with regard to payment of money of toddy. As such, the petitioner may not be extended the privilege of bail. Considering the aforementioned facts and circumstances of the case and that the petitioner has got a clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.- V, Nawada, in connection with Sirdala P.S.
