JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 386, 414, 419, 120B/34 of the Indian Penal Code.
Petitioner is said to have been caught on the spot and three mobile sets are said to have been recovered from his conscious possession. Furthermore, one Scorpio vehicle was also seized from the place of occurrence.
Contention on behalf of the petitioner is that petitioner had hired the aforesaid Scorpio and as a matter of fact, he had gone to his village but unfortunately, he was caught on suspicion. It is further contended that so far as recovered mobile
Patna High Court Cr.Misc. No.12160 of 2016 (2) dt.29-03-2016 2/2 sets are concerned, the same are not looted or stolen property and so far as Scorpio is concerned, the same has already been released in favour of its owner. It is further contended that prior to institution of the present case, only two cases had been registered against the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dehri-on-Sone in connection with Rohtas, Nauhatta P.S. Case No. 63 of 2015.
