ANJANA MISHRA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Chanipur P.S. Case No. 95 of 2014 registered for the offences punishable under Sections 284/120B and 307 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Learned counsel for the petitioners submits that there are general and omnibus allegations against all members of the family including one cousin Gotni. It is alleged in the First Information Report that the said cousin Gotni in connivance with the petitioners and the husband of the informant gave poisonous roti
Patna High Court Cr.Misc. No.49084 of 2014 (2) dt.30-04-2015 P2/2 to the informant as a result of which, she suffered uneasiness and thus the First Information Report.
Learned counsel for the petitioner has produced before me an order dated 21.01.2015 passed in Cr. Misc. No. 2813 of 2015 by which this Court has extended the privilege of anticipatory bail to the petitioner Minta Devi. It is contended that these petitioners being similarly situated and being on a much better footing may also be extended the privilege of anticipatory bail. Considering the aforementioned submissions and the order dated 21.01.2015 passed in Cr. Misc. No. 2813 of 2015, let the petitioners, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 95 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
