The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No. 115 of 2013 registered for the offences punishable under Section 302 the Indian Penal Code and Section 27 of the Arms Act.
The case diary of the present case was called for which has since been received.
Considering the fact that several witnesses who were present at the place of occurrence had stated that this petitioner had helped the main assailant Gaurav Kumar Rai to escape on his motorcycle, I am not inclined to grant anticipatory bail to the petitioner. It is accordingly, rejected.
However, if the petitioner surrenders and seeks regular
Patna High Court Cr.Misc. No.28991 of 2015 (3) dt.05-10-2015 bail within a period of two weeks, the Court below may consider the regular bail application of the petitioner without being prejudiced by the present order.
