Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Baisi P.S. Case No. 229 of 2020 (Special Excise Case No. 376 of 2020) registered for offences under Sections 272 and 273 of the Indian Penal Code and Section Sections 30(A), 41 and 47 of the Bihar Prohibition and Excise Act, 2016. Huge quantity of foreign liquor was recovered from the truck which is a commercial vehicle.

Petitioners have filed supplementary affidavit

Patna High Court CR. MISC. No.67115 of 2021(8) dt.08-02-2022 2/2 annexing documents to show that the truck was booked for sending goods to Singjamei Parking, Manipur and while returning therefrom, driver of the truck might have loaded illicit liquor.

Considering the submissions of the petitioners and considering the fact that petitioner no.1 is the owner of the truck and petitioner no.2 is own brother of petitioner no.1 and the truck in question is commercial one and it is not expected that the owner of the truck will be travelling therewith while the truck is transporting the goods, the application for anticipatory bail is allowed.

Accordingly, let petitioners, above-named, in the event of their arrest or surrender within ten weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Purnea in connection with Baisi P.S. Case No.229 of 2020 (Special Excise Case No. 376 of 2020), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
