JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.

The victim went missing on 07.01.2016 but subsequently, she was recovered and her statement under Section 164 of the Cr.P.C. was recorded on 13.01.2016. In the aforesaid statement, though she stated that she was forcibly taken away by the petitioner but fairly admitted that she was in love with the petitioner and she was taken by the petitioner at different places. The victim has nowhere stated about any other ill-treatment at the hands of the petitioner, except the allegation of so-called kidnapping.

Patna High Court Cr.Misc. No.13173 of 2016 (2) dt.01-04-2016 2/2 Contention on behalf of the petitioner is that the victim was in love with petitioner and as a matter of fact, being major she eloped with the petitioner but when she came under the clutches of her parents, she made twisted statement. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 20 of 2016.
