The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 427 and 511 of the Indian Penal Code.

As per the prosecution case, information was received about an attempt having been made by the accused persons stealing an ATM. On going to the place of occurrence sum of Rs. 1,26,400/- was found to be safe. However, on seeing the video footage some accused persons with mask could be seen. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. Referring to the order of the learned trial court, it is submitted that the name of the petitioner transpired in the confessional statement of coaccused Murari Kumar made before police. No incriminating

Patna High Court CR. MISC. No.67416 of 2021(2) dt.26-04-2022 2/2 article has been recovered from the petitioner's possession. He is in custody since 25.8.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, no incriminating article having been recovered from the petitioner's possession together with the petitioner having remained in custody for 8 months, the petitioner is directed to be enlarged on bail in connection with Vaishali (Belsar O.P.) P.S. Case no. 178 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
