The petitioner apprehends his arrest in connection with Parbatta P.S. Case No. 24 of 2015 registered for the offences punishable under Sections 467, 468, 420 and 409 the Indian Penal Code.

Learned counsel for the petitioner submits that the defalcated amount as alleged in the first information report has already been deposited by the petitioner vide receipt dated 26.02.2015 which stands justified by Annexure -7. So far as the registers are concerned, petitioner submits that the same have already been deposited.

No.29109 of 2015 (3) dt.05-10-2015 Considering the aforesaid submissions and also the fact that there is no question of defalcation, as the petitioner has deposited the entire amount prior to the lodging of the first information report, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachhia, Bhagalpur in connection with Parbatta P.S. Case No. 24 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
