The petitioner seeks regular bail in connection with Ben P.S. Case No. 06 of 2017 for the offences punishable under Section 304(B)/34 of the Indian Penal Code.
The allegation is regarding the accused persons especially the husband of the victim lady having killed the victim lady on account of non-fulfillment of demand of dowry. The learned senior counsel for the petitioner submits that the Viscera report of the deceased is yet to come, hence the complicity of the petitioner at the moment does not stand proved beyond doubt. The petitioner is stated to be languishing in custody since 02.02.2018.
Per contra, the learned counsel for the informant has
Patna High Court Cr.Misc. No.26898 of 2018 (4) dt.09-07-2018 2/2 vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case as also upon perusal of the case diary, I do not find any merit in the present case and the complicity of the husband i.e. the petitioner herein is writ large which is apparent from a bare perusal of the records of the case. Accordingly, the present petition is dismissed.
At this juncture the learned senior counsel for the petitioner submits that the petitioner be granted liberty to renew his prayer for bail once the Viscera report is received. The liberty is granted.
