The petitioner apprehends his arrest in Chakai P.S. Case no. 82/2013, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioner is alleged to have assaulted the informant with tangi on his head. The informant Kailaswa Devi got injured.

It is submitted that on account of land disputed the occurrence took place. There is a counter version. Both the sides assaulted each other causing injury to each other but from perusal of the FIR itself, it appears that there is specific allegation that the petitioner assaulted the informant with tangi on her head and corresponding injury is also found on the head of the informant.

Patna High Court Cr.Misc. No.40695 of 2015 (2) dt.05-10-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
