JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 429, 467, 468, 120 B, 323 and 504/34 of the Indian Penal Code. As per the prosecution case, one Sambhu Singh and one Vinod Kumar Singh got transferred a piece of land in favour of their wife and son, respectively, which belongs to the complainant/informant, through two registered sale deeds dated 18.06.2013.

Learned counsel for the petitioner has submitted that the petitioner has been made accused only because he was the deed writer.

In view of the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of Sri S. K. Mishra, learned Judicial Magistrate, Sadar, Motihari, East Champaran, in connection with Chakia P.S. Case No. 246 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
