The petitioner seeks bail in Bihiya P.S. Case No. 191 of 2017 registered for the offence punishable under Sections 341, 324, 302/34 of the Indian Penal Code.

Informant is the brother of the deceased and in his fardbeyan he has stated that deceased-Dharmendra Yadav had gone to Bihia for treatment of his maternal uncle Sadhu Yadav and Sadhu Yadav asked him to remain there in the meanwhile he will attend the court proceeding in Jagdishpur and when he was standing near Bihiya Dak Bungalow eight persons came on three motorcycle at about 9: 30 am and assaulted his brother with knife and rod as a result of which he died on the spot. The petitioner has been made accused on the basis of suspicion only and it has been further stated that the petitioner had deposed against Sadhu Yadav. Except suspicion there is no incriminating material against the petitioner. The petitioner has got no criminal antecedent and is in custody since 12.08.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th A.C.J.M. Bhojpur at Arrah in connection with Bihiya P.S. Case No.191 of 2017.
