ANJANA MISHRA ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner, Complainant and learned counsel for the State.
The petitioner has been in custody since 02.08.2017 in connection with Complaint Case No. 166 of 2009 for the offence registered under Sections 323, 379, 498A and 504 of the Indian Penal Code and also for misuse of privilege of bail. Learned counsel for the petitioner submits that since he was unable to make payment of the maintenance amount to his wife and children, his bail bonds were cancelled. Learned counsel for the petitioner further submits that if he continues to stay behind the bar, he shall be unable to arrange anything towards the payment. As such, he may be granted regular bail.

No.5798 of 2018 (2) dt.02-02-2018 Having heard learned counsel for the petitioner, informant and the arguments advanced by the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Pupari Sitamarhi in connection with Complaint Case No. 166 of 2009 corresponding to Trial No. 364 of 2017.
It is, however, made clear that if the petitioner does not take appropriate steps towards their maintenance amount, it shall be open for the Complainant to move the Court below or this Court for cancellation of the order passed today. (Anjana Mishra, J) Jagdish/- U T
