Mr. Sri Madhuranand Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-07-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Guthni P.S.Case No. 176 of 2017 registered under Sections 302 and 379/34 of the Indian penal Code. Allegation in brief is that informant found her son in unconscious state and while he was being brought to hospital in Siwan, on the way he disclosed that he was assaulted by the accused persons.
Submission is that as per allegation deceased was killed by strangulation and was not alive rather brought dead in the hospital so there was no question of giving any statement by the deceased to the informant, however it is said to be the honour killing as deceased was in love affair with one Sangeeta Kumari
Patna High Court Cr.Misc. No.27434 of 2018(4) dt.10-07-2018 2/2 and accused persons are her family members and she has stated in para-10 of the case diary that deceased was killed by her brother Amit Kumar.
Having considered the aforesaid facts and circumstances and the statement of Sangeeta Kumari in para-10 of the case diary, it was Amit Kumar who strangulated the deceased, so petitioners, namely , Muneeb Dhobi, Raju Baitha and Yogendra Baitha, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Guthni P.S. Case No. 176 of 2017.
