Mr.Nawal Kishore Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-08-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kasba P.S. Case No. 282 of 2018, registered under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is that in the evening of 22.10.2018, Vikash Kumar, son of the informant, Navin Thakur, had gone to his maternal grandmother to take his mother. At about 7 P.M., mother of the informant talked to her grandson then he replied that he will come within half hour. In the next morning, when the informant woke up then found that the dead body of his son, Vikash Thakur, was hanging on the railing of his house. No.54364 of 2019(2) dt.30-08-2019 2/2 brother-in-law of the informant and his wife, Ranju Devi (petitioner no.2), who is also mother of the deceased, committed the murder of his son and the dead body was hanged in his house. Learned counsel for the petitioners submits that petitioner no. 1 is brother-in-law and petitioner no. 2 is wife of the informant, who used to reside at her Maika, in fact, deceased, son of the informant, died in unnatural death at his house but with ulterior motive, both petitioners, who are maternal uncle and mother of the deceased, have falsely been implicated in this case. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Kasba P.S. Case No. 282 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
