JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 392 of the Indian Penal Code.
As per prosecution case, the informant and his father were robbed by three miscreants of their motorcycle and cash of Rs. 1,00,000/-. They also took away the mobile phone of the informant along with the accounts register of the shop of the informant. Patna High Court CR. MISC. No.63270 of 2022(4) dt.21-02-2023 2/2 been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has not been put on T.I.P. The petitioner was remanded in this case from other case. The other similarly situated co-accused Prince Kumar Paswan has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 46318 of 2022. The petitioner is languishing in custody since 25.04.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, V, Darbhanga in connection with Manigachhi P.S. Case No. 18 of 2022.
