2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 115(2), 316(5), 318(4), 132, 308(3), 352, 351(2)/3(5) of the Bhartiya Nyaya Sanhita.
3. It is alleged that co-accused Abhay Bikram Shah, who was Chairman of the Managing Committee of Prince Mohan Bikram Shah College, Ramnagar, in connivance with petitioner and other co-accused illegally withdrawn Rs. 35 Lakhs. It is further alleged that on 21.08.2024, all the accused persons, including petitioners, came in the college premises,
Patna High Court CR. MISC. No.60266 of 2025(2) dt.08-09-2025 2/3 abused & assaulted informant and others and also forcefully opened Almirah and took away all the relevant documents.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Petitioners, being retired Clerk and Head Clerk, are simply victims of false implication due to dispute between the Managing Committee and the informant. He further submits that petitioners are not authorized to withdraw any amount from the college account and as per resolution of Executive Committee dated 05.08.2017, the chairman Abhay Vikram Sah is the permanent signatory for withdrawal of money from the college account and other signatory is Principal of the college and as such, withdrawal of money, as alleged by the informant, is not illegal. He further submits that even informant had illegally withdrawn Rs.2,50,000/- from the college account for his personal benefit, but when the matter was reported to the local Police, he deposited that money in the college account. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their

No.60266 of 2025(2) dt.08-09-2025 3/3 arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ramnagar P.S.
