The petitioner apprehends her arrest in CII-29/2013, Tr. No. 3343/2014, registered for the offences punishable under Section 47 of Excise Act.

The petitioner is said to have been running illegally liquor shop and 30 litres country made liquor was recovered. It is submitted that seizure was made on 13.08.2012, but the prosecution report was submitted on 06.01.2013. It appears from the prosecution report that the house of the petitioner was not raided. She is alleged to have been running the shop at lonely place, but she was not apprehended on the spot. Considering the facts aforesaid and the fact that the petitioner is lady, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.40831 of 2015 (2) dt.06-10-2015 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Siwan in connection with C II-29/2013, Tr. No. - 3343/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
