ANJANA MISHRA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Khagaria (Gangaur) P.S. Case No.233 of 2015 for allegedly having committed the offences under Sections 341, 323, 324, 307, 427 and 379 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners submits that the allegation against the petitioners is false and mischievous and has been occasioned only because of the facts that there was a land dispute between the parties and that these petitioners had objected to the purchase of the land belonging to the ancestors of these petitioners by the informant. Patna High Court Cr.Misc. No.29422 of 2015 (3) dt.06-10-2015 submits that there is no specific allegation against these petitioners of firing at the informant or having indulged in Lootpat.
Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S. Case No.233 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
