2. The petitioner seeks regular bail in connection with Excise P.S. Case No. 424 C2 of 2025 for the offences registered under Sections 30(a) of the Bihar Prohibition & Excise Act.

3. There is recovery of 16 litre country made liquor and 50Kg Jawa Mahua from near the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to village politics. Nothing has been recovered from the conscious possession of the petitioner. The alleged Mahua liquor has not been recovered from the house of the petitioner rather it has been recovered from near the house of the petitioner. Petitioner has no criminal antecedent. He is in

Patna High Court CR. MISC. No.55747 of 2025(2) dt.20-08-2025 2/2 custody since 12.07.2025. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VII-cum-Exclusive Special Excise Court-II, Lakhisarai in connection with Excise P.S. Case No. 424 C2 of 2025.
