JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Chauri P.S. Case No. 57 of 2017 for the offence under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the case was registered against unknown. He further submits the name of the petitioner has been surfaced on the basis of confessional statement of co-accused Amrendra Yadav @ Buta, who has been granted bail vide order dated 02.02.2018 passed in Cr. Misc. No. 6080 of 2018. He further submits that the petitioner is languishing in jail since 05.12.2017.
Considering the fact that the co-accused, who has disclosed the name of the petitioner, has already been granted bail by a Co-ordinate Bench of this Court, the petitioner, named above,
Patna High Court Cr.Misc. No.27832 of 2018 (3) dt.03-07-2018 2/2 is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Bhojpur at Ara in connection with Chauri P.S. Case No. 57 of 2017.
