JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-11-2022 At the outset, the learned counsel for the petitioner seeks permission to add the Circle Officer, Kasba, DistrictPurnia as party respondent no. 7 to the present writ petition. Permission so sought, is granted.

The needful be done during the course of the day. The present petition has been filed seeking the following relief :- "(i) For issuance of an appropriate writ/ writs in the nature of mandamus for direction to respondents for removing/ demolishing the illegal construction on public road/ land in

Patna High Court CWJC No.19790 of 2021(2) dt.07-11-2022 2/2 Mauza-Ghurdaur, Thana no. 186, Khata no.

283, Plot no. 405, Area-1 decimal 500 kari, Purnia Sadar, District-Purnia, though the encroachment removal order has been passed by Sub- Divisional Officer, Purnia on 16.07.2021."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Kasba, Purnia for redressal of his aforesaid grievances. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Kasba, Purnia by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
