The petitioner seeks bail in Rafiganj P.S. Case No. 129 of 2012, registered for the offences punishable under Section 386 and other Sections of the Indian Penal Code and Section 17 of the C.L.A. Act.
Allegation against the petitioner is that the petitioner along with other Maoists extremists had assembled at the place of occurrence for holding Jan Adalat and collecting levy. Learned counsel for the petitioner submits that it appears that the informant identified the petitioner and others while they were fleeing away. The informant has not disclosed the source of identification. The petitioner is in jail since 08.04.2013. Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.49748 of 2014 (3) dt.08-04-2015 2/2 petitioner had remained in jail for two years, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 129 of 2012.
