This is an application for grant of anticipatory bail in connection with Rupauli (Mohanpur) P.S. Case No. 43 of 2016 registered for the offence punishable under Sections 147, 148, 149, 323, 324, 225 and 225(B) of the Indian Penal Code. It is alleged that when the Police party had gone to arrest an accused, namely, Dhruv Mahto and after they were returning upon arresting the said Dhruv Mahto, several people had assembled at the place of occurrence and were engaging in brick batting on the Police vehicle resulting in one of the stone hitting the police official. The name of the petitioner is said to have
Patna High Court Cr.Misc. No.2517 of 2018 (2) dt.24-01-2018 2/2 surfaced in the FIR.
The learned counsel for the petitioners submits that there is a general and omnibus allegation against the petitioners herein and they have been falsely implicated in the present case by the Police. It is further submitted that the petitioners herein have a clean antecedent.
Having regard to the facts and circumstances of the of the case, I deem it fit and proper to enlarge the petitioners herein on anticipatory bail in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, upon furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Purnea in connection with Rupauli (Mohanpur) P.S. Case No. 43 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
