JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 22.06.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kursakanta P. S. case no. 61/2017 registered under section 302/34 of the IPC.
Informant claims that the deceased was killed by the petitioners and others but in course of investigation, it came to light that the deceased committed suicide. Some witnesses claimed that the petitioners used to torture the deceased. Petitioner nos.1 and 2 are bothers whereas petitioner nos.3, 4 and 5 are nephews of husband of the
Patna High Court Cr.Misc. No.27612 of 2018 (3) dt.22-06-2018 deceased and it is submitted that they are separate from the husband of the deceased. Postmortem report of the deceased also corroborates this fact that the deceased committed suicide.
Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Kursakanta P. S. case no. 61/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
