JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2017 Heard counsel for the petitioner and APP for the State. The petitioner seeks bail in a case registered for offence under sections 302/34 of the IPC. FIR has been lodged alleging murder of the informant's daughter.

Counsel for the petitioner submits that the allegations made in the FIR are only on the basis of the suspicion and there is nothing on the record to suggest that who has committed the offence. The petitioner happens to be the mother-in-law of the deceased and other similarly situated accused persons have already been allowed bail by a bench of this Court vide order dated 2.9.2015, passed in Cr.Misc.No.37119 of 2015. Petitioner has no antecedent and he is in custody since 29.8.2017. In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as mentioned above, be released on bail on her furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Judicial Magistrate 1st class, Jamui in Chakai Police Station Case No. 61 of 2014 on the following conditions:-

No.56291 of 2017 (2) dt.13-12-2017 (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how she is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if she fails to do so on two consecutive dates, her bail will be liable to be cancelled.
