JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner is seeking regular bail in Shahkund (Sajour) P.S. Case No. 263 of 2017 registered under Sections 379, 411, 188/34 of the Indian Penal Code and Rule 40 of Bihar Minor Mineral Concession Rule, 1972 and Rules 6/8 of Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.

It is submitted that one trailor filled with sand has been seized from possession of this petitioner. The petitioner claims to be the driver of the vehicle in question and has no criminal antecedent.

Considering the facts and circumstances of the case, let
