JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 28.1.2018, seeks bail in Laukariya PS Case No. 6 of 2018 registered under Sections 385 and 387 of the IPC.

The allegation in brief is that from a particular sim no. 9678731935 demand of extortion of five lakh rupees was made from the informant and repeated calls were made demanding extortion. Learned Counsel for the petitioner submits that the sim mentioned in the FIR does not belong to the petitioner, it is in the name of Sanjay Ram another accused, CDR does not show that the mobile bearing imei number of the petitioner was ever used for making demand of extortion by using the sim mentioned in the FIR and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Hemant Kumar @ Sumant Kumar @ Hemal Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sandeep Patel, Judicial Magistrate, lst Class, Bagaha, West Champaran in connection with Laukariya PS Case No. 6 of 2018.
