The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302, 341, 504, 506, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. It is a case of commission of murder of the informant's second wife namely, Rabiya Praveen. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The petitioner is not named in the F.I.R and nothing has been recovered regarding this case. He has falsely been implicated in the present case by the police merely on suspicion. He has no concern with the alleged occurrence or with the F.I.R. named

Patna High Court CR. MISC. No.62101 of 2023(2) dt.15-09-2023 2/2 accused persons. During investigation, no consistent evidence has come against him. There is no specific overt-act against this petitioner. Similarly situated other accused person has already been enlarged on bail by this Bench vide order dated 28.07.2023 passed in Cr. Misc. No.45510 of 2023. The petitioner is languishing in judicial custody since 09.02.2020. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Lalganj P.S. Case No.176 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Vaishali at Hajipur.
