Petitioner, already in custody, seeks bail in connection with Ayar P.S. Case No.04 of 2018 registered under Sections 147, 149, 341, 323, 302 and 504 of the Indian Penal Code. Allegation in brief is that the petitioner along with two other persons turned up at the door of the informant and assaulted her father-in-law with lathi and danda as a result he died. The motive of the occurrence is enmity due to land dispute.
Learned counsel for the petitioner submits that only one injury is found over the head of the deceased and there is allegation against three persons of assaulting indiscriminately to the deceased; whereas the learned counsel for the informant
Patna High Court Cr.Misc. No.27324 of 2018(5) dt.10-07-2018 2/2 opposes the prayer of bail.
The learned APP appearing on behalf of the State refers the statement of the wife of the deceased and according to her statement, the head injury was given by one Sri Bhagwan Singh, another accused, and there is only one ante-mortem injury on the head.
Having considered the aforesaid facts and circumstances, petitioner Dadan Yadav @ Dadan Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur (Ara) in connection with Ayar P.S.
